Terms of Service

These Terms of Service ("Terms") govern your use of the websites, mobile applications, and related services provided by Neon Blue Labs, LLC ("Neon Blue Labs," "we," "us," or "our"). We refer to these collectively as the "Services."

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Use Of The Services

You may use the Services only if you can legally agree to these Terms and comply with applicable laws.

You must be at least 13 years old to use the Services. If a specific Service has a higher age requirement, that higher requirement applies.

Some Services may be available without an account. Other Services may require an account, subscription, app-store purchase, or other access method.

Some Services may have additional terms, rules, disclosures, or purchase terms. If additional terms apply, they will be presented with that Service and will control only for that Service if they conflict with these Terms.

2. Accounts

If a Service allows or requires account creation, you agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.

Some apps may use anonymous installation identifiers instead of accounts. In those cases, deleting the app, reinstalling it, or changing devices may affect access to locally associated data, history, preferences, or saved content.

3. Subscriptions, In-App Purchases, And Paid Features

Some Services may offer subscriptions, in-app purchases, free trials, credits, usage limits, or paid features.

Pro subscriptions include unlimited scans for normal personal, non-automated use. To protect service reliability, prevent abuse, and manage excessive automated or abnormal usage, we may apply temporary fair-use limits, rate limits, or other technical controls. If you believe you reached a limit during normal personal use, contact us at support@neonbluelabs.com.

Material prices, billing periods, renewal terms, trial terms, and included features will be presented at or before purchase as required by applicable law and platform rules. Subscriptions generally renew automatically unless canceled before the applicable renewal deadline, which may be at least 24 hours before the end of the current period depending on the platform or payment provider.

For mobile apps, purchases are usually processed by Apple App Store or Google Play. You can manage or cancel subscriptions through your Apple or Google account settings. Deleting an app does not automatically cancel a subscription.

Refund requests for Apple App Store purchases should be submitted to Apple. Refund requests for Google Play purchases may be handled through Google Play or, where available or required, through tools provided to us by Google Play. Platform refund rules apply.

For purchases made outside the Apple App Store or Google Play, payment may be processed by Stripe or another third-party payment provider. Those purchases are subject to the payment terms shown at checkout and the applicable payment provider’s terms. Unless required by law or stated at checkout, fees are non-refundable.

We may share limited usage or consumption data with Apple, Google, or another payment provider when needed to help process refund requests, verify access, prevent fraud, or comply with platform policies.

If you download a mobile app through the Apple App Store or Google Play, your use of that app may also be subject to the applicable store’s terms. If those terms conflict with these Terms for store-managed purchases or subscriptions, the store terms control for those purchase or subscription matters.

4. Free Usage Limits And Premium Access

Some Services may provide limited free usage before requiring payment. We may change free limits, premium features, trial availability, pricing, or access rules at any time, subject to applicable law and platform requirements.

Attempts to bypass usage limits, paywalls, subscriptions, entitlement checks, or technical restrictions are prohibited.

5. User Content

Some Services may allow you to upload, submit, create, store, or share content, including photos, images, files, text, comments, prompts, notes, feedback, or other materials ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, analyze, modify for technical purposes, and use your User Content as needed to provide, operate, secure, troubleshoot, support, and improve the Services, subject to our Privacy Policy and any applicable Service-specific settings.

You represent that you have the rights needed to submit your User Content and that your User Content does not violate laws, third-party rights, privacy rights, intellectual property rights, or these Terms.

6. AI-Assisted Features

Some Services may use artificial intelligence or automated systems to generate results, classifications, summaries, recommendations, estimates, creative outputs, or other content.

AI outputs may be inaccurate, incomplete, outdated, or unsuitable for your situation. Unless a specific Service expressly states otherwise, AI outputs are informational only and are not professional advice.

You are responsible for independently reviewing and verifying AI outputs before relying on them. Do not use AI outputs as the sole basis for legal, financial, medical, insurance, safety, authentication, appraisal, tax, or other high-impact decisions.

For apps that identify, estimate, classify, value, or interpret objects, images, collectibles, documents, or other submitted content, results are estimates only and are not guarantees, certifications, appraisals, authentications, or expert opinions.

The Services are not designed for emergency use, safety-critical use, or situations where failure or inaccuracy could cause death, personal injury, property damage, or significant legal, financial, or other harm.

7. Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation.
• Infringe or violate another person’s rights.
• Upload illegal, harmful, abusive, deceptive, unauthorized, or privacy-invasive content, including content that violates another person’s privacy or publicity rights.
• Submit highly sensitive personal information, such as government IDs, financial account numbers, health information, or similar sensitive data, unless a specific Service explicitly requests it.
• Interfere with or disrupt the Services.
• Attempt unauthorized access to systems, accounts, data, or infrastructure.
• Reverse engineer, decompile, modify, or tamper with the Services except where law expressly permits.
• Scrape, harvest, bulk download, or extract data from the Services without permission.
• Use automated scripts, bots, bulk scanning workflows, or other non-human usage patterns to generate excessive scan volume, bypass limits, or interfere with the Services.
• Use bots, scripts, or automation to abuse the Services.
• Circumvent subscriptions, paywalls, usage limits, security controls, or access restrictions.
• Upload malware or malicious code.
• Misrepresent outputs from the Services as professional advice, certification, authentication, appraisal, or guaranteed results.
• Use the Services to create, distribute, or facilitate harmful, fraudulent, or unlawful activity.
• Use the Services if you are located in, or are a resident of, a country or region subject to applicable embargoes or sanctions, or if you are on a restricted-party list under applicable law.

We may suspend or terminate access if we believe you violated these Terms or created risk for users, the Services, our providers, or our business.

8. Intellectual Property

The Services, including software, designs, interfaces, branding, logos, graphics, text, workflows, databases, and other materials, are owned by us or our licensors and are protected by intellectual property laws.

These Terms do not transfer ownership of the Services to you. You may not copy, modify, distribute, sell, lease, or create derivative works from the Services unless we give written permission or the law permits it.

You may submit feedback or suggestions. If you do, we may use them without restriction or compensation to you.

9. Third-Party Services

The Services may rely on or link to third-party services, including app stores, payment processors, analytics providers, AI providers, hosting providers, crash reporting tools, advertising networks, and support tools.

We are not responsible for third-party services, content, policies, outages, billing systems, or actions. Your use of third-party services may be subject to their own terms and privacy policies.

10. Privacy

Our collection and use of information is described in our Privacy Policy, available at https://www.neonbluelabs.com/privacy. By using the Services, you acknowledge our Privacy Policy.

11. Changes To The Services

We may modify, suspend, discontinue, or limit any part of the Services at any time. We may also change features, pricing, free limits, supported platforms, AI models, providers, or availability.

We are not responsible for loss of access to features, content, or data caused by changes to the Services, device changes, deleted apps, expired subscriptions, platform restrictions, or discontinued products, except where required by law.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, misuse the Services, create risk, or if we discontinue a Service.

Termination does not automatically cancel subscriptions purchased through Apple App Store, Google Play, or another payment provider. You must cancel through the applicable platform or payment provider.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, payments owed, disclaimers, limitation of liability, indemnity, governing law, dispute-related terms, and relevant content licenses.

13. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not guarantee that the Services will be uninterrupted, secure, error-free, accurate, complete, or suitable for your needs.

14. Limitation Of Liability

To the fullest extent permitted by law, Neon Blue Labs, LLC, its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost revenue, loss of goodwill, business interruption, subscription issues controlled by third-party platforms, or decisions made based on outputs from the Services.

To the fullest extent permitted by law, our total liability for any claim related to the Services will not exceed the greater of:

• The amount you paid us for the specific Service giving rise to the claim during the three months before the claim; or
• USD $50.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Neon Blue Labs, LLC, its owners, employees, contractors, affiliates, and service providers from claims, damages, liabilities, losses, and expenses arising from your use of the Services, your User Content, your violation of these Terms, or your violation of another person’s rights.

16. Governing Law And Disputes

These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law rules.

Nothing in these Terms limits any consumer rights that cannot be waived under applicable law. You and Neon Blue Labs agree that any disputes will be handled in the courts with jurisdiction under applicable law, unless otherwise required by law.

17. Changes To These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Your continued use of the Services after changes are posted means you accept the updated Terms.
